Our client, a Client Relations Director in the media industry, was dismissed from her position. The notice of termination stated that she lacked the necessary competence to manage clients — that she was failing to manage a key client relationship effectively, that the client was dissatisfied, and that the employer had no choice but to let her go.
Our client approached us to assist with drafting the statement of claim and to represent her in court.
What we did?
- We filed a claim with the court. In the course of the proceedings, we proved that the fault lay not with our client but with the company itself — the employer had failed to provide an adequate team to service the client.
- Evidence of extensive overtime and employees’ complaints to HR demonstrated that our client was entirely experienced and competent, but had not been given the tools necessary to meet the employer’s client management demands.
- We managed the entire process from start to finish. We examined witnesses whose testimony helped establish facts favourable to our client.
- The court awarded our client compensation and confirmed that the termination had been unlawful.
