An increasing number of employees are raising questions concerning the remuneration principles applied by their employers. Why are employees performing comparable roles remunerated differently? Why has one employee received a salary increase while another has not?
Until recently, such questions could often be addressed by means of a general response, such as: “This is a management decision.”
In light of the forthcoming legal framework, however, such an explanation may no longer be sufficient.
The new pay transparency regime extends well beyond the use of gender-inclusive job titles and the publication of salary ranges in job advertisements.
It represents a fundamental shift in the manner in which employers will be required to determine, substantiate and justify remuneration decisions. Employers will be expected to demonstrate that any differences in remuneration are based on objective, legitimate and verifiable criteria, rather than on arbitrary or discretionary decision-making.
The new legislative framework introduces significant additional obligations for both HR functions and management. During this webinar, we will discuss practical steps that employers can take to prepare their organisations for employees’ requests concerning remuneration, as well as for potential employment litigation.
