Deciding to grant a salary increase may appear straightforward – until the decision has to be justified. Promotion, individual performance, commitment, or remuneration negotiated at the recruitment stage may all constitute reasons for awarding a higher salary. In practice, however, these reasons are not always applied consistently or documented in a manner that allows them to be substantiated at a later stage.
This lack of documentation and consistency most often becomes problematic when an employee asks why they are paid less than a colleague performing the same or a comparable role.
The new pay transparency framework places employers in a significantly more demanding position.
This is no longer a matter of internal policy or managerial discretion. Employers will be required to establish clear, objective and consistently applied remuneration criteria, and to demonstrate that pay differentials are based upon such criteria. A salary increase granted simply because it was considered “well deserved” may now expose the employer not only to employee dissatisfaction, but also to evidentiary challenges, as the burden of proof rests with the employer.
